Currently, there is no law stating that a homeowner must remove and underground storage tank from their property. However, if you are going to sell your property, mortgage companies may require documentation that a tank has been removed or abandoned.
An underground storage tank can either be removed or legally abandoned (when necessary). The tank removal must be done by a licensed contractor. A permit must be pulled and the fee must be paid prior to the day of the tank removal. We need a minimum of 72 hours notice for the removal/abandonment, as the Fire Marshal must be on site to witness the removal/abandonment and taking of the soil sample by the contractor.
No tanks shall be removed prior to Fire Marshal arrival, no exceptions. A copy of the soil analysis report shall be sent to the Fire Marshal's Office for our records.
